By engaging the services of McK Photography Ltd, the client ("Client") agrees to the following terms: Ownership and Copyright: The Photographer retains full ownership and copyright of all media taken. The Client is granted a non-exclusive, non-transferable license to use the media for property marketing purposes only. The media may not be sold, licensed, or transferred without written consent from the Photographer. Usage Restrictions: The Client may not alter, edit, or remove watermarks or copyright notices on the media. The media must not be used in a defamatory, obscene, or illegal manner, or infringe upon the rights of any individual or entity. Payment and Delivery: Payment is due as agreed, and the final edited media will be delivered within a reasonable timeframe. Until full payment is received, the Photographer may withhold the delivery of the media. Liability: The Photographer is not liable for unforeseen circumstances or events beyond their control that may result in the loss, damage, or delay of the media. The Client is responsible for obtaining necessary permissions and releases for elements featured in the media. Indemnification: The Client agrees to indemnify the Photographer against any claims arising from the Client's use or misuse of the media, including copyright violations. Termination: Either party may terminate this Agreement with written notice. Upon termination, the Client must cease using the media and return or destroy any copies. Governing Law: This Agreement is governed by the laws of New Zealand. Any disputes shall be resolved through negotiation, mediation, or the courts of New Zealand. By engaging the Photographer's services, the Client acknowledges and agrees to these Terms and Conditions.
